The sword is indeed sentient/conversant, it's where the spirit resides until the fusion dance takes place. Thus, the Medicine Seller's prime objective is going to be getting the sword back, his soulmate lives in there.
The balancing scales have the effect of detecting malicious spirits (the mononoke in his canon), and will tip in their direction. They appear to have a very low level of sentience as they can move on their own and in multiple instances have bowed at people.
Due to the lack of magical evil, it's likely both the scales and paper talismans will be mostly inert, although I imagine the scales could tip in the direction of a particularly nasty Imperial.
And thus, they could count as a magical item. Only issue is they're seemingly infinite. In the spirit of keeping everything fair (and mostly to reduce headaches on the mod team's part), if they are a magical item I'd say there's only about fifteen he needs to retrieve. If not...cross that bridge when we get to it.
